May 22, 2026 2019 FEMA Completion Hearing The hearing was open at 10:00 A.M. by Chairman, Mike Maguire Present: Mike Maguire, Brandon McHugh, Trustees, Jon Rosengren, Ryan Hull, Eric Burnhagn, Bolton & Menk, Inc., Catherine Brehmer, Iowa Homeland Security, Michelle Kersten, Drainage Clerk, and Richard Soukup, landowner. A Completion Hearing was held for the Upper Boyer Drainage District 2019 Flood Repairs. Discussion was held and the following was discussed. Section A: Three Oaks Construction, Inc bid $168,601.75. Final construction cost is $166,126.75. Section A holds a 10% retainage in the amount of $16,612.68 from the contractor. A change order was issued for a slight reduction of Revetment, Class D of -$235.00 and the removal of Item No. 5, Removal of Flood Debris of -$2,240.00 for a total decrease of -$2,475.00. Completion date, April 14, 2026. Section B: Pruett Grading, LLC bid $395,716.00. Final construction cost is $633,670.56. Section B holds a 10% retainage in the amount of $63,367.06 from the contractor. A change order was issued during the construction of the project for a decrease in Revetment Class D of -$4,445.44 and a large increase of $242,400.00 in Hydraulic Seeding for a total increase of $237,954.56. Completion date, November 28, 2025. Section C: Three Oaks Construction, Inc bid $318,385.75. Final construction cost is $318,573.75. Section C holds a 10% retainage in the amount of $31,857.38 from the contractor. A change order was issued at the end of the project for a slight increase of Revetment, Class D for $188.00. Completion date, April 14, 2026. Section D: D&D Construction, Inc bid $366,659.50. Final construction cost is $368,886.83. Section D holds a 10% retainage in the amount of $36,888.68 from the contractor. A change order was issued during the construction of the project for an increase of Revetment, Class D for $2,227.33. Completion date, February 28, 2026. Section E: Three Oaks Construction, Inc bid $153,021.63. Final construction cost is $155,747.44. Section E holds a 10% retainage in the amount of $15,574.74 from the contractor. A change order was issued at the end of the project for a small increase of Revetment, Class D in the amount of $2,725.81. Completion date, December 15, 2025. Second B landowner, J. Pryor Farms, LLC., has crop damages that are estimated to total $143.39. Maguire made a motion to cover the cost out of the district funds, seconded by McHugh. Motion carried. Damages on Section C were worked out between the contractor and the landowner and were repaired by the contractor. A motion to approve all five contracts as completed and to release retainages 30 days from today was made by Maguire, second by McHugh. Motion Carried.
