CITY OF LOGAN ORDINANCE #486 AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF LOGAN, IOWA, BY MODIFYING CHAPTERS 15, 17, 30, 31, AND 78 TO REMOVE REFERENCES TO A CITY POLICE DEPARTMENT AND ELMINATE THE STICKER FEE FOR UTV’S Be It Enacted by the City Council of the City of Logan, Iowa: SECTION 1. SECTION MODIFIED. Chapter 15, Mayor, Section 3, Appointments, of the Code of Ordinances of the City of Logan, Iowa, is repealed and the following adopted in lieu thereof: “15.03 APPOINTMENTS. The Mayor shall appoint the following officials: 1. Mayor Pro Tem 2. Library Board of Trustees 3. Community Development Commission 4. Zoning Administrator 5. Building Inspector 6. Tree Commissioner.” SECTION 2. CHAPTER REMOVED. Chapter 30, Police Department, of the Code of Ordinances of the City of Logan, Iowa, is hereby repealed. SECTION 3. SECTION ADDED. Chapter 17, City Council, is hereby amended to add a Section 7, Contract Law Enforcement, which shall state as follows: “17.07 CONTRACT LAW ENFORCEMENT. The Council may contract with the County Sheriff or any other qualified lawful entity to provide law enforcement services within the City and in such event the Sheriff or such other entity shall have and exercise the powers and duties of the Police Chief as provided herein.” SECTION 4. CHAPTER REMOVED. Chapter 31, Reserve Peace Officers, of the Code of Ordinances of the City of Logan, Iowa, is hereby repealed. SECTION 5. SECTION MODIFIED. Chapter 78, Operation of Off Road Utility Vehicles (UTVS) on City Streets, Section 10, Identification Sticker, is repealed and the following adopted in lieu thereof: “78.10 IDENTIFICATION STICKER. No person shall operate a UTV on any public street or alley under jurisdiction of the City unless there is prominently displayed on the UTV a valid identification sticker issued by the City of Logan, Iowa. An identification sticker will be issued for each calendar year and shall expire on December 31st at midnight of the calendar year.” SECTION 6. SEVERABILITY CLAUSE. If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional. SECTION 7. WHEN EFFECTIVE. This ordinance shall be in effect from and after its final passage, approval and publication as provided by law.
