ORDINANCE NO. 615 AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF MISSOURI VALLEY, IOWA, BY AMENDING PROVISIONS PERTAINING TO SOLID WASTE CONTROL Be It Enacted by the City Council of the City of Missouri Valley, Iowa: SECTION 1. NEW SECTION. The Code of Ordinances of the City of Missouri Valley, Iowa, is amended by adding a new Section 105.13, which is hereby adopted to read as follows: 105.13 CITY YARD WASTE SITE. The designated City yard waste site shall be subject to all posted signage at the facility, as well as the following restrictions: Use Restricted to City Residents. The City yard waste site is for use by residents of the City of Missouri Valley only. The disposal of commercial waste, including waste from landscaping or tree service businesses, is prohibited. Permitted Materials. The only materials permitted for disposal at the City yard waste site are: o Grass clippings o Yard brush o Leaves Tree branches no larger than eight (8) inches in diameter Prohibited Materials. The disposal of any materials other than permitted yard waste is strictly prohibited. Any person found dumping unauthorized materials may be cited for littering under this chapter or any other applicable City ordinance.Non-Residents and Commercial Dumping. Any non-resident or commercial entity disposing of any materials at the City yard waste site shall be subject to citation under this chapter or any other applicable City ordinance. Penalties and Enforcement. Violations of this section shall be subject to penalties as set forth in the Schedule of Fees. In addition to any fines, violators may be responsible for the costs associated with the removal and proper disposal of unauthorized materials. SECTION 2. SEVERABILITY CLAUSE. If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional. SECTION 3. WHEN EFFECTIVE. This ordinance shall be in effect from and after its final passage, approval and publication as provided by law.
