CITY OF LOGAN ORDINANCE #487 AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF LOGAN, IOWA, BY AMENDING CHAPTER 105, SOLID WASTE CONTROL, SECTION 4, OPEN BURNING RESTRICTED, TO REMOVE SUBSECTION 6, TRAINING FIRES, SUBSECTION 7, PESTICIDE CONTAINERS AND SEED CORN BAGS, SUBSECTION 8, AGRICULTURAL STRUCTURES, AND SUBSECTION 9, CONTROLLED BURNING OF A DEMOLISHED BUILDING Be It Enacted by the City Council of the City of Logan, Iowa: SECTION 1. SUBSECTIONS REMVOED. Chapter 105, Solid Waste Control, Section 4, Open Burning Restricted, Subsection 6, Training Fires, Subsection 7, Pesticide Containers and Seed Corn Bags, Subsection 8, Agricultural Structures, and Subsection 9, Controlled Burning of a Demolished Building, of the Code of Ordinances of the City of Logan, Iowa, are hereby repealed and removed. SECTION 2. Chapter 105, Solid Waste Control, Section 4, Open Burning Restricted, Subsection 10, Variance, of the City Code of Ordinances of the City of Logan, Iowa, is hereby renumbered to become Subsection 6 as follows: “6. Variance. Any person wishing to conduct open burning of materials not permitted herein may make application for a variance to the Director of the State Department of Natural Resources. (IAC, 567-23.2[2])” SECTION 3. REPEALER. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. SECTION 4. SEVERABILITY CLAUSE. If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional. SECTION 5. WHEN EFFECTIVE. This ordinance shall be in effect from and after its final passage, approval and publication as provided by law.
